This service is operated by Mark Parkhouse Antiques & Jewellery and markparkhouse.co.uk.

References to “we” “us” “our” “Sales Consultant” mean Mark Parkhouse Antiques & Jewellery and/or markparkhouse.co.uk

References to “you” and/or “your” mean the purchaser buying goods from us subject to these Terms and Conditions.

These Conditions of Sale apply to any order placed through our Website or Sales Consultant and if you do not accept these Conditions of Sale,you will not be able to complete your order.Mark Parkhouse Antiques & Jewellery may modify the Conditions of Sale at it’s sole discretion from time to time and your continued use of the website shall be deemed to be your acceptance of those changes.It is your responsibility to ascertain whether any such changes have been made.In the event that any provision of the Conditions of Sale shall be determined to be unenforceable,the validity and enforceability of the remaining provisions of the Conditions of Sale shall not be affected

2.Availability and Acceptance

2.1 All orders are subject to availability.In the course of processing your order,we will email you if any items are not available.Please note that Products are not placed on order until you have completed the checkout process.Orders online may not exceed the value of £2,000.00 (two thousand pounds GBP (£) )in any buying session on the Site.For orders in excess of £2,000.00,payment may be made by bank wire transfer – the product pages of the Site provide you with an enquiry button which we will respond to with our bank details for payment and you may also call a Sales Consultant on :01271 374504 who will provide you with further information as to product availability and assist you with your purchase.
2.2 By placing an order through our Site,you warrant that you are legally capable of entering into binding contracts,that you are over eighteen years of age,are living in the UK and that you agree to be bound unconditionally by these Terms & Conditions.
2.3 Orders can be placed on the telephone through one of our Sales Consultants on : 01271 374504 or online by creating an account on our website.In each case,all orders are subject to these Terms & Conditions and you will need to provide accurate details of : Your Title, Surname, First Name, email address, phone number and delivery and billing address. For your website account,you are responsible for maintaining the confidentiality of your account username and password and for preventing unauthorised access to your account.You accept responsibility for all activities that occur under your account or password,please therefore take all necessary precautions to ensure that the username and password is kept confidential and secure.Please inform us immediately if you have any reason to believe that your username and/password has become known to anyone else,or are being,or are likely to be used in an unauthorised manner.It is also your responsibilty to inform us of any changes in your details ( e.g. change of email or postal address ).You can access and update your details using the ‘My Account’ page of the Website .

2.4 We reserve the right to refuse access to the Website,terminate accounts,remove or edit contents or cancel orders at our discretion. If we do cancel an order,it will be without charge to you.

3.3 Once you have placed your order,you will receive an ‘Acknowledgment of Order’ email,setting out the details of your order.Please note that this email is an acknowledgment of your order only,it does not mean that we have accepted your order.Your order constitutes an offer to purchase a Product/s subject to these Terms & Conditions.
3.4 All orders are subject to acceptance by us and we will communicate our acceptance by sending you a ‘Dispatch Confirmation’ email informing you that the Product/s has been dispatched . The contract of sale between us is formed only when we send you the Dispatch Confirmation.The contract will only relate to the Product/s detailed in the Dispatch Confirmation.We will not be obliged to supply any other Product/s forming part of your order until we have confirmed dispatch of the same in a separate Dispatch Confirmation email.
3.5 We reserve the right not to accept your order if we have insufficient stock to deliver the Product/s you have requested.Mark Parkhouse Antiques & Jewellery reserve the right to refuse,cancel and terminate orders at any moment in time on reasonable grounds,for example if there is an on-going dispute concerning payment for a previous order or if we suspect that you have breached these Conditions of Sale.
3.6 If we do not accept your order,we will notify you by email or telephone and we will refund any money received from you using the same method originally used by you to pay for your purchase.
We shall not be obliged to offer any compensation for disappointment suffered.


4.1 The prices payable for Products are in pounds sterling and include VAT at the rate prevailing at the date of Dispatch.
4.2 We may vary Product and delivery charges at any time but this will not affect orders in respect of which a Dispatch Confirmation email has already been sent.If the change in VAT rate occurs between the date your order is placed and the date we are ready to ship your order,we will contact you and ask that you reconfirm your order.If we cannot obtain your instructions,we will treat your order as cancelled and notify you of the same.
4.3 We do our utmost to ensure that prices on our site are accurate.However,if an error is found in your order,we will contact you as soon as possible and invite you to reconfirm your order at the correct price or,alternatively you may choose to cancel your order.If you decide to cancel,we will refund/re-credit you for any sum paid by you for your order.If we are unable to contact you,we will treat the order as cancelled.


5.1 You may pay by credit or debit card,or by bank wire transfer as indicated on the website or through a Sales Consultant on the telephone. We must receive payment in full for the price of the Product/s that you order, plus shipping, prior to our acceptance of your order.
5.2 Only those Products displaying an ‘Add to Basket’ button are available for sale on the website. In any buying session on the website, orders may not exceed the value of £2,000.00 ( two thousand pounds sterling GBP ). You may exceed this limit when payment is made by bank wire transfer, please telephone a Mark Parkhouse Antiques & Jewellery Sales Consultant who will provide you with further information as to product availability and assist you with your purchase.
5.3 All online payments are carried on secure, encrypted servers and no credit card details are retained.
5.4 If paying by credit or debit card,your billing and delivery address must be within the UK and we can only deliver to your billing address.
5.5 When ordering on the site,you will need to enter your payment details on the appropriate form.If you order by telephone,you will need to provide our Sales Consultant with your credit or debit card number and your three or four digit security code which is printed on the back or front of your card.If the issuer of your payment card refuses authorisation of payment to us,then you will need to contact your card issuer direct to resolve this and we will not be liable for any delay or non-delivery.
5.6.If you pay by bank wire transfer,we will wait until payment is received before processing your order.If the funds are not credited to our bank account within ten working days after you have placed your order,this order will be cancelled.
Mark Parkhouse Antiques & Jewellery will not charge a fee for paying by bank wire transfer,but please note that your bank may do so.

5.7 We regret that we cannot accept cheques or cash as payment online.Please note that we cannot guarantee the security of data when communicating with Mark Parkhouse Antiques & Jewellery via email or fax.For details of the security measures we employ please read our Privacy Policy.Unless we are fraudulent or negligent we will not be liable to you for any losses caused as a result of unauthorised access to the personal and transactional information you provide us with when placing an order.


6.1 With the exception of purchases paid for by Direct Bank Transfer,we only accept online orders for delivery to UK billing addresses and we do not ship to PO boxes or hotels.

We use Royal Mail Special Delivery Next Day Service.

Delivery charges for all UK addresses are £10.

If you place your order online on Friday before 12 noon, it will be processed and posted on Friday for a Monday delivery.This does not apply to Bank Holidays

We endeavour to dispatch your order within two working days.Orders placed after 4pm will be processed the following working day.Personalising the Products with engraving will extend this time,please  request a revised estimated dispatch date when arranging the engraving with us.

We will deliver the Products ordered by you to the address for delivery which you provided us with at the time when you placed your order.It is your responsibility to ensure that the address which you provide is correct in every particular and that an adult is present at the address to sign for and take delivery of  the Products.

Parcels will need to be signed for by an adult in person at the delivery address,at which point responsibility for your purchased Product passes to you. If no adult is present to sign, a Special Delivery Notification Card will be left at the delivery address with information on re-delivery/collection from your local Royal Mail Collection Depot.

We cannot accept responsibility for parcels that Royal Mail have been unable to deliver, nor parcels which have been left without a signature at your request. If your order is returned to us because delivery could not be effected for whatever reason,then you will be liable for the costs of delivery and any redelivery costs.All parcels must be opened and checked before signing the receipt for delivery.We will not be held responsible for damaged or missing items once the receipt of delivery has been signed.In the event of damage or missing items,please make a note on the delivery slip and contact us within 24 hours of delivery by email : sales@markparkhouse.co.uk

Tracking : You may track your order through the Royal Mail Special Delivery Tracking Reference number on your Dispatch Confirmation email which we will send you when your order has been shipped. You can also locate your tracking reference number and a tracking link by logging on to your ‘My Account’ page of the Website.

Delivery time is subject to clearance of payment and product availability and there are some remote areas of the UK, such as the Highlands and Islands, where Royal Mail cannot guarantee next day delivery.


7.1 Ownership of the Products will pass to you when we receive full payment due in respect of the Products and delivery charges.

8.Cancellation,Returns and Refunds

8.1 We hope that you will be delighted with your purchase.However ,if the Products are delivered to your address in a faulty condition,please return them with proof of purchase within 28 days of delivery following the returns procedure set out in Clauses 8.3 and 8.4 below and we will arrange for an exchange or refund,subject to availability.We regret that we are unable to offer exchange or refund on personalised Products (Products which have been engraved or modified for you ) bespoke orders or pierced earrings except where the Product is faulty.
8.2 With the exception of personalised Products,bespoke orders or pierced earrings,you may also cancel the contract between us within a period of 7 working days,beginning with the day after the day on which the Product was delivered .Notice of cancellation must be served in accordance with Clause 9 below.The procedure for returning the Product is set out in Clause 8.4 below.
8.3 To return Products which you believe have been delivered to you in a faulty condition,you must first : Email sales@markparkhouse.co.uk within 14 days of delivery with notice of your intention to return your purchase and a brief description of the defect affecting the Product.
8.4 The procedure for returning the Product is as follows : Within 28 days of delivery,you must return the Product using the Royal Mail Special Delivery Service and insured to the Products’ full value.We cannot accept any returns using a different service or delivery company.The goods must be packed securely in the original packaging that you received them in,together with proof of purchase.You must retain the shipping and postage receipt for returning the package.We accept no liability in the event that proof of return shipment cannot be produced.All responsibility is on you the customer to appropriately insure the return shipment,until a delivery signature is accepted at Mark Parkhouse Antiques & Jewellery,106 High Street,Barnstaple,Devon,EX31 1HP.Receipt by us of the returned Product must have taken place before a refund can be processed.
8.5 If you return your purchase to us because you have cancelled the contract between us under clause 8.2 above,then once we have received the Product,we will refund the price of the Product within 30 working days.
8.6 If you return the Product because you believe the Product is defective,we will examine the returned Product and determine whether it is defective.If we are satisfied that the Product is defective,we will notify you  by email of your entitlement to a refund.We will undertake this process as swiftly as possible and endeavour to process the refund within 30 working days of the email confirming a refund was due to you.We will refund the price of the defective product and delivery charges.
8.7 We will refund any money received from you using the same method originally used by you to pay for your purchase.
8.8 No refund or exchange will be provided where Products are returned incomplete or damaged.


9.1 All notices given by you to us must be given in writing to Mark Parkhouse Antiques & Jewellery,106 High Street,Barnstaple,Devon,EX31 1HP and also by email to : sales@markparkhouse.co.uk. We may give you notice,either at the email or postal address you provided when you placed your order.

10.Rights and Obligations

10.1 You may not transfer,assign,charge,sub-contract or otherwise dispose of the contract between us or any of your rights and obligations under it without our prior written consent.
10.2 We may transfer,assign,charge,sub-contract or otherwise dispose of a contract,or any of our rights and obligations arising under it,at any time during the term of the contract.
10.3 We shall not be in breach of these Terms & Conditions or liable for any delay in the performance of our obligations under a contract resulting from circumstances beyond our reasonable control.
10.4 While we make every effort to ensure our Website is accurate as possible, dimensions and measurements on our website are approximate values only and,products may not be actual size and we cannot guarantee that colours in our images will appear correctly on different computer monitors,mobile phones or tablets.

11.Governing Law and Jurisdiction

11.1 These Conditions of Sale shall be governed by English law and will be subject to the jurisdiction of the courts of England and Wales.
